Our Contract

Here at AGS our goal is to put a healthy, well-started puppy into your home.  Your puppy will have been evaluated in order to be placed into the very best home for him/her.  It will also have been health checked by a qualified veterinarian; microchipped, and will have had all needed vaccinations and wormings.

If a puppy is found to have any health issues or abnormalities by our vet during its last exam the buyer will be informed of any such issue and will have the decision to either accept said puppy "as is" or to choose to get another puppy instead when one becomes available.

Adalheit German Shepherds agrees to warranty above puppy:

Up to 2 years of age from any genetic problem we have tested for that would keep the puppy from living a normal and healthy life as a pet/companion animal.  Any problems(genetic or otherwise)associated with breeding will not be warranted as we are not selling this puppy strictly as a breeding animal. 

 

If a claim for a genetic problem is made, we must have written verification from 2 separate qualified licensed Veterinarians(not vet techs).  These need to not be in the same practice nor in any way related so as to get non-biased results.  With that, the diagnosis or the description of the problem must be agreed upon by both Veterinarians.  This will be done at the cost of the buyer.  We also reserve the right to have the puppy re-evaluated by our own vet(at our own expense).

 

If the puppy is found to have a genetic defect, the puppy will be replaced with a comparable puppy when one is available.  We are not responsible for contagious diseases, illness or injury due to improper handling or accidental death.  If any of these are the reason for the puppies illness or death all warranties made by AGS are null and void.

 

To be signed by buyer and seller:

 

  AGS agrees to warranty hips and elbows up to 2 years of age from any genetic problem.  A certified Orthopedic Veterinarian must provide written diagnosis and x-rays(at the cost of the buyer)which clearly identifies dysplasia or any other defect that has NOT occurred due to accidents, over-exercising, stress related problems, improper feeding or mishandling of this puppy as these issues can lead to hip or elbow dysplasia and will not be covered by the guarantee thus making all warranties null and void.

  If the above guarantee has been met by both parties and a puppy needs to be replaced, AGS will provide another puppy of the same quality, age, gender(of choice)and value.  We do not ask that you return the original dog to us but since we are a small family hobby breeder a replacement may not be immediately available.  We will provide a puppy as soon as we have one available.  This guarantee is limited to one replacement puppy, only for the original buyer of the puppy.

  AGS will not honor any of the terms of the guarantee if a female has been mated and becomes pregnant before the age of 2 years old.

  AGS will reserve first right of ownership of the puppy(at no cost to the breeder)if the owner intends to sell or transfer ownership of the puppy for ANY reason.  This applies only to the original owner.  We also may be able to help you rehome your puppy if you are unable to keep him/her.  

  Buyer has agreed to have the puppy checked by a licensed veterinarian within a 7 day business window from the purchase date at the buyers expense.  Any vet bills associated with this puppy after purchase are the sole responsibility of the buyer.  AGS will not reimburse monies for any vet bills.

  Buyer agrees to provide this puppy with a safe, secure home where the puppy will be able to thrive.  With this, the buyer agrees to provide the puppy with an adequate home and yard fit for a large breed dog, and provide adequate quality food, water and shelter from the elements.

  If AGS finds the puppies' needs are not being met and the standard of living for the puppy is not a secure, healthy situation AGS reserves the right to remove the puppy from the home at no cost to the breeder. 

 

  AGS will not be responsible for any legal expenses or legal liability incurred by the buyers during their ownership of the dog or due to any activity of the dog during their ownership.

  AGS is a small seasonal operation, therefore we will offer NO CASH REFUNDS.

The entire Agreement between the parties is contained herein.  In the event of a dispute, the state of Nebraska will have jurisdiction over this matter.

Should a dispute arise, the buyer agrees to pay any attorney fees and/or court costs necessary to settle said dispute.

This agreement also acts as a Bill of Sale.  By signing it, the buyer agrees that he/she is receiving the puppy described in item #1.

Adalheit German Shepherds reserves the right to refuse a sale at ANY time if we do not feel it is a good fit for the buyer or the puppy.
